These Terms of Service (“Terms”) govern your access to and use of the Personal AI platform, including our website, mobile applications, artificial intelligence assistant services, and the Personal AI Assistant Notifications SMS program (collectively, the “Services”), provided by Personal AI, Inc. (“Personal AI,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Personal AI Assistant Notifications Program

1.1 Program Name

The SMS notification service is operated under the name Personal AI Assistant Notifications.

Personal AI Assistant Notifications provides users who have opted in with recurring automated SMS messages containing daily briefings, task reminders, priority alerts, schedule updates, travel notifications, and other personalized information generated by your Personal AI assistant.

The purpose of the program is to help users stay informed and productive by delivering timely, relevant information directly to their mobile phones, even when they are away from their primary devices.

1.3 Message and Data Rates

Message and data rates may apply. Standard messaging and data rates charged by your mobile carrier will apply for all messages sent to and received from the Personal AI Assistant Notifications program. You are solely responsible for all charges incurred through your mobile carrier in connection with the program.

1.4 Message Frequency

Message frequency varies and is user-configured. Depending on your personal settings, preferences, and activity within the platform, you may receive:

One primary daily briefing, typically delivered in the morning
Task and deadline reminders as they become relevant
Proactive priority alerts for time-sensitive or important matters
Schedule and travel updates when changes are detected

1.5 Opt-Out Instructions

After opting out, you will no longer receive SMS communications from this program. You may re-subscribe at any time by replying START or by re-enabling SMS notifications in your account settings.

6. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

Personal AI does not warrant that the Services will be uninterrupted, error-free, or completely secure. You acknowledge that the AI assistant provides suggestions and information based on available data and should not be relied upon as professional, legal, financial, or medical advice.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERSONAL AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

8. Indemnification

You agree to defend, indemnify, and hold harmless Personal AI and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.

9. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may terminate your account at any time through your account settings or by contacting support.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in San Francisco County, California.
